These Terms of Service ("Terms") constitute a legal agreement between you ("User," "you," or "your") and GetTaller ("Company," "we," "us," or "our"). By accessing, downloading, or using the GetTaller mobile application (the "App"), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the App.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the App. Your continued use of the App following any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.

2. License & Usage Rights

We grant you a limited, non-exclusive, non-transferable, revocable license to use the GetTaller App for personal, non-commercial purposes. This license:

• Is personal to you and cannot be transferred to anyone else
• Permits you to download and use the App on your personal mobile devices
• Does not allow you to reverse-engineer, decompile, or disassemble the App
• Does not allow you to remove or alter any copyright, trademark, or proprietary notices
• Does not allow you to use the App for any commercial purpose or public display
• Does not grant you ownership of the App or its content

3. Intellectual Property Rights

All content, features, and functionality of the GetTaller App—including but not limited to text, graphics, logos, designs, images, software, code, and algorithms—are the exclusive property of GetTaller, its developers, contributors, or their respective licensors and are protected by international copyright, trademark, and other intellectual property laws.

You agree not to:

• Reproduce, duplicate, or copy the App or its contents for any purpose
• Modify or create derivative works based on the App
• Distribute, sell, rent, or transmit the App
• Remove or alter any intellectual property notices or attribution
• Use the App's content to create competing products or services

4. User Responsibilities & Conduct

By using GetTaller, you agree to:

A. Legal Use

• Use the App in compliance with all applicable laws, regulations, and these Terms
• Not use the App for illegal, harmful, or abusive purposes
• Not engage in activities that could harm, disable, or impair the App's functionality

B. Prohibited Behavior

You agree not to:

• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation or servers
• Use the App to transmit viruses, malware, or harmful code
• Attempt to reverse-engineer or hack the App
• Use automated tools or bots to access the App without permission
• Scrape, crawl, or extract data from the App
• Harass, abuse, or intimidate other users
• Violate any person's rights, including privacy or intellectual property

C. Data Accuracy

You are responsible for providing accurate and truthful health data (age, height, weight, etc.). Inaccurate data may result in incorrect predictions and recommendations. GetTaller is not responsible for conclusions drawn from false information you provide.

5. Health Disclaimer & Not Medical Advice

Important: GetTaller provides general health and fitness information for educational purposes only. It is not:

• A substitute for professional medical advice, diagnosis, or treatment
• Intended to diagnose, treat, cure, or prevent any disease or condition
• A replacement for consulting with qualified healthcare professionals
• Based on personalized medical evaluation or testing

Medical Consultation Required

Before using GetTaller or implementing any recommendations, you must consult with a qualified healthcare provider, especially if you:

• Have existing health conditions or take medications
• Are pregnant or nursing
• Are under 18 years old (parental guidance recommended)
• Have orthopedic or spinal issues
• Have concerns about height, growth, or development
• Experience pain or discomfort during exercises

User Assumption of Risk

By using GetTaller, you acknowledge and assume all risks associated with the app's use, including:

• Physical exercise risks (injury, muscle strain, etc.)
• Psychological risks (unrealistic expectations, disappointment)
• Health complications from using the app's recommendations

Height Predictions

Height predictions provided by GetTaller are estimates based on genetic and lifestyle factors. Actual results may vary significantly based on:

• Individual genetics and medical conditions
• Hormonal factors and development stage
• Nutrition quality and consistency
• Adherence to exercise recommendations
• Sleep quality and duration
• Other environmental and lifestyle factors

GetTaller makes no guarantees about height gain or results. Individual results will vary.

6. Limitation of Liability

Limitation of Damages

To the fullest extent permitted by law, GetTaller shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunity
• Physical injury or health complications from using the App
• Damages from third-party services integrated with the App
• Any other damages arising from your use or inability to use the App

In no event shall our total liability exceed the amount paid by you for the App (if any).

7. Third-Party Services & Content

GetTaller integrates with third-party services, including:

• Google Firebase: For analytics, crash reporting, and cloud functions
• Google Mobile Ads (AdMob): For serving advertisements

These services are governed by their own terms of service and privacy policies. We are not responsible for:

• Third-party service availability or performance
• Third-party terms of service or policies
• Data collected by third-party services
• Damages or issues arising from third-party services

8. Ads & Monetization

GetTaller is free to use but supported by advertisements. By using the App, you agree to:

• View and interact with non-personalized advertisements
• Allow AdMob to serve ads based on your device's advertising ID
• Acknowledge that clicking ads may take you to external websites
• Accept that we are not responsible for third-party advertisers' content or practices

We do not endorse any advertised products or services. Interactions with advertisers are at your own risk.

9. App Store Terms

GetTaller is distributed through app stores (Apple App Store, Google Play Store). Your use of the App is also governed by:

In the event of conflict between these Terms and the app store's terms, the app store's terms govern your purchase and usage of the app via their platform.

10. Termination

We may terminate or restrict your access to the App at any time, with or without cause, including if you:

• Violate any of these Terms
• Engage in prohibited behavior or abuse
• Attempt to harm or disrupt the App
• Violate applicable laws or regulations

Upon termination, you must stop using the App immediately. Termination does not affect your local data, which remains on your device until you manually delete or uninstall the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless GetTaller, its developers, and their agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Health issues or injuries from your use of the App's recommendations
• Any claims by third parties related to your use of the App

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App:

• Are subject to the exclusive jurisdiction of the courts of the United States
• Must be resolved through binding arbitration (except for injunctive relief)
• Cannot be brought as a class action
• Must be initiated within one (1) year of the claim arising

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, severed from these Terms. The remaining provisions remain in full force.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetTaller regarding your use of the App. These Terms supersede all prior agreements, understandings, and negotiations, whether oral or written.
